This “policy” will only last as long as his administration anyway. Republicans don’t have enough of a majority to make something so asinine and hateful a constitutional amendment.
He possibly can, but this will basically only affect federal paperwork: The Census, IRS, military enlistment, and so on. It doesn’t mean ungendered restrooms are going away, and it doesn’t affect the states.
It’s bluster and insult, the things he does best.
Passports. A lot of folks might have to get new passports if their old ones are rendered invalid because of the gender marker.
Tbh, I never fixed mine (to X) because that felt like increasing my risk while traveling, when I can stealth as my assigned gender while on travel/outside my comfort zone.
So many things we need to focus on as a country, and this is what the priority is. Or, at least, this is what we hear about. Either way, it’s ridiculous.
There are other priorities too!
Banning vaccines, forcing women to die from unviable pregnancies, destroying public education, and a whole lot more!

BERRIESCULTURE WAR NONSENSE
So, cannabis is actually still very much illegal on a federal level, but tons of states have policies that legalize it for medical or recreational use. Technically, federal law does take precedence over state law, but the Constitution is (somewhat purposefully) vague as to what powers belong to the federal government, so the federal government leaves the states alone because they don’t wanna fuck around and find out. Therefore, cannabis stays legal in those states.
The case would be very much the same for any laws relating to gender. States would have all but official power to do whatever the fuck they want.
